Debt collection laws and official resources

Mississippi

Mississippi's Attorney General Consumer Protection Division enforces the Mississippi Consumer Protection Act and identifies federal Fair Debt Collection Practices Act enforcement among its consumer work. Consumer and commercial debt protections differ. Preserve collection notices and document threats or misrepresentations rather than assuming a collector's demand proves legal liability.

Federal context

The federal Fair Debt Collection Practices Act limits the conduct of covered debt collectors collecting consumer debts. It generally does not cover an original creditor collecting its own debt or business debts. State protections may be broader. CFPB: which laws apply (opens in a new tab)

Lawsuit response information

Mississippi

Mississippi Justice Court handles smaller civil claims, including past-due accounts. A summons and hearing date must not be ignored. Mississippi Justice Court Help explains preparing documents and what to expect; its guidance warns that missing a civil hearing can result in default. Other courts may require different responses.

Federal context

Check the summons, court rules, and any hearing date promptly. Missing the applicable response deadline can lead to a default judgment. A complaint to a consumer agency or a letter to the collector is not a court response. CFPB: if you are sued (opens in a new tab)

Wage garnishment rules and exemptions

Mississippi

Mississippi judgment collection can involve wages, bank funds, or property. Justice Court Help supplies post-judgment resources, and Hinds County Justice Court lists local garnishment materials. Ask the court handling your case about its exemption or objection process and provide records identifying protected funds. Do not use another county's forms without confirmation.

Federal context

For ordinary consumer debts, federal law generally limits weekly withholding to the lesser of 25% of disposable earnings or the amount above 30 times the federal minimum hourly wage. A more protective state rule controls where applicable. Support, taxes, and federal student loans have different rules. Read the federal guide

Debt validation information

Mississippi

Covered Mississippi consumer collectors must honor federal debt-validation protections. A timely written dispute generally must be sent within 30 days after receiving validation information. Keep proof of delivery. Disputing with the collector does not excuse attending a Mississippi hearing or filing a response required by the court.

Federal context

A covered debt collector generally must provide validation information, including the end date of the 30-day dispute period. A timely written dispute triggers verification protections. This collection-notice period is separate from any court response deadline. CFPB: validation information (opens in a new tab)

Consumer protection agencies

Mississippi

The Mississippi Attorney General Consumer Protection Division provides a consumer-complaint route for potentially unlawful business practices. Include collection notices and a dated description of events. An enforcement complaint does not establish a defense, stop garnishment, or extend court deadlines; handle litigation and regulator complaints separately.
